Seller offers a 2 year guarantee on any life threatening genetic condition (i.e. heart, lung, liver or major organ) on said puppy diagnosed to be hereditary. The licensed veterinarian's diagnosis must be made and submitted in writing along with x-ray and ultrasound findings to the Seller by the attending veterinarian. If the puppy is sold locally, the puppy in question will then be taken to a licensed veterinarian of the Seller's choice along with the first diagnosis and original x-ray and ultrasound findings for a second opinion. If the puppy was sold out of state, Seller requires a second opinion from another licensed veterinarian within Buyer's area chosen by the Seller and at the Seller's expense, in order to verify the diagnosis. Should the first and second opinions be conclusive of a life threatening genetic condition buyer may keep the affected dog, as is, with no other implied or written warranties/guarantees, as a pet, as long as there is quality of life. Seller will give buyer another puppy as soon as possible at no additional cost to buyer. Buyer must make all the arrangements involved in picking up their replacement puppy.
Seller guarantees that the above described puppy is a purebred Cavalier King Charles Spaniel with American Kennel Club (AKC) and the Cavalier King Charles Spaniel Club (CKCSC) registered parents, and is eligible for registration with AKC and CKCSC. All puppies are registered with limited registration and are to be spayed/neutered around 6 months of age. (_______________ date at 6 months). If this guarantee should be needed in the event of a life-threatening health issue arising in said puppy proof of spay/neuter must be shown. If said puppy is over 6 months of age and still intact this guarantee cannot be acted on until said puppy is spayed/neutered.
The parents of your puppy are of high quality and excellent temperament. As a reputable breeder, Seller asks that you take exceptional care of your puppy throughout its life. This includes providing socialization, medical and dental care, and proper nutrition. If for any reason, you are unable to keep said puppy at any point in said puppy’s lifetime, you are required to contact Seller before re-homing or selling said puppy. If Buyer is re-homing puppy with a family member or friend Seller needs to be notified of this transfer before the transfer takes place. Seller needs to always know where all offspring are in case another sibling has a health issue so Seller can follow up with all littermates if the need should arise. Seller will take said puppy back at any time with no questions asked if needed (no monetary reimbursement, but seller will pay all shipping expenses should shipping be required). Seller will also help re-home said puppy should re-homing become necessary.
This contract shall be deemed a legal and binding agreement between Seller and Buyer and is under the jurisdiction of the State of Oklahoma in the County of Comanche. It is further agreed that should any dispute/arbitration arise between Seller and Buyer regarding said puppy, the legal venue shall be the County of Comanche, Oklahoma. Buyer will be held responsible for any and all costs associated with returned checks, collection and/or attorney fees.
